Acceptance of Terms

Welcome to Nano Banana AI, also referred to as "Company", "we", "us", or "our".

By accessing or using our website, AI image generation tools, account features, subscriptions, credit packs, APIs, or related services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.

Age Restrictions

You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher, to use Nano Banana AI. By using the service, you represent that you meet this requirement. We may suspend or terminate accounts that violate this rule.

Description of Services

Nano Banana AI provides a credit-based AI image generation platform. Users can submit prompts and reference images, select supported image models, generate AI outputs, manage task history, purchase credit packs or subscriptions, and access related account or support features.

We may update, modify, suspend, limit, or discontinue any feature, model, pricing option, output format, or provider integration at any time. AI results may vary and are not guaranteed to match a prompt, reference image, style, quality expectation, or commercial objective.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate account and billing information, keep it updated, and notify us promptly if you suspect unauthorized access.

You may not share, sell, transfer, or allow others to use your account in a way that violates these Terms, bypasses plan limits, abuses credits, or harms the service.

Credits, Subscriptions, and Billing

Nano Banana AI uses credits to run generation tasks. Different models, resolutions, and settings may consume different credit amounts. Credits may be granted through subscriptions, one-time credit packs, promotions, or account activity.

• Paid subscriptions are billed in advance for the selected billing period.
• Subscription credits may expire at the end of the applicable billing period or as described at checkout.
• One-time credit packs may have their own validity period.
• Free, promotional, bonus, trial, or check-in credits have no cash value and are not refundable.
• Prices, credits, model availability, and plan benefits may change over time, but completed purchases are governed by the terms shown at checkout and these Terms.

You are responsible for taxes, payment provider fees, exchange-rate differences, bank fees, and any charges caused by inaccurate billing information.

Cancellation

You may cancel an active subscription through the billing or account area when cancellation is supported by the payment provider. Cancellation stops future renewals but does not automatically refund prior charges or restore consumed credits. Access to subscription benefits may continue until the end of the current paid period unless otherwise stated by the payment provider or required by law.

Refunds and Credit Adjustments

Because Nano Banana AI provides digital services and credits are delivered immediately after purchase, refunds are limited.

You may request a refund review if all of the following are true:

1. The request is submitted within 10 days of the original purchase date.
2. Paid credits from that purchase remain unused.
3. You provide a clear reason and enough account or transaction information for review.

If approved, a refund may be full or partial. Partial refunds may be calculated based on remaining unused paid credits from the purchase. Used credits, expired credits, promotional credits, free credits, accounts suspended for violations, fraudulent activity, refund abuse, and purchases already disputed through a chargeback are not eligible for refund.

If an AI generation task fails because of a system or provider error, consumed credits for that failed task may be automatically revoked or returned to your account. Prompt quality, user error, policy rejections, dissatisfaction with subjective output quality, or choosing the wrong settings do not guarantee a refund.

Prohibited Uses

You agree not to use Nano Banana AI for any of the following:

• Unlawful, fraudulent, deceptive, harmful, or abusive activity.
• Content involving minors in sexual, exploitative, abusive, or unsafe contexts.
• Non-consensual intimate imagery, sexual deepfakes, impersonation, or defamatory depictions of real people.
• Harassment, threats, stalking, bullying, doxxing, or targeted abuse.
• Hate speech or content promoting violence, discrimination, or dehumanization against protected classes.
• Graphic violence, self-harm encouragement, terrorism, extremist recruitment, or instructions for real-world harm.
• Spam, phishing, malware, credential theft, scraping, or unauthorized automation.
• Infringement of copyright, trademark, privacy, publicity, or other third-party rights.
• Attempts to bypass safety systems, rate limits, payment controls, authentication, or access restrictions.
• Reselling, sublicensing, or redistributing the service without written authorization.
• Any activity that disrupts, damages, overloads, or impairs the service.

Violations may result in rejected prompts, removed outputs, credit loss, account suspension, termination without refund, and reporting to authorities where required.

Content Standards and Safety

All prompts, uploads, reference images, generated outputs, and shared content must comply with these Terms, applicable law, and the rights of others.

We may use automated filters, provider safety systems, rate limits, abuse detection, and manual review of reports or flagged activity to enforce these rules. We reserve the right to block prompts, reject uploads, remove outputs, restrict access, or suspend accounts at our discretion.

Severe violations, including child sexual abuse material, non-consensual sexual content, credible threats, or attempts to evade safety systems, may result in immediate permanent termination and legal reporting.

User Content and Rights

You are responsible for the prompts, uploads, reference images, and other content you submit. You represent that you have all rights and permissions needed to use that content with Nano Banana AI.

As between you and us, you retain any rights you have in your input content. You grant us a limited license to host, process, transmit, display, store, and use your content as needed to provide the service, operate safety systems, resolve support requests, and comply with law.

AI-generated outputs may not be unique, may resemble outputs generated for others, and may be subject to third-party rights or legal limits. You are responsible for reviewing outputs before using them commercially or publicly.

Intellectual Property

The Nano Banana AI website, software, user interface, branding, documentation, templates, pricing structure, and service infrastructure are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reverse engineer, modify, scrape, or create derivative works from the service except as allowed by law or with our written permission.

Third-Party Services

Nano Banana AI may rely on third-party providers for payments, authentication, storage, analytics, email, and AI model processing. Their services may be subject to their own terms and privacy practices. We are not responsible for outages, delays, safety decisions, or changes caused by third-party providers.

Disclaimers

The service is provided "as is" and "as available". We do not guarantee uninterrupted availability, error-free operation, specific generation results, model availability, output accuracy, legal suitability, or commercial fitness. AI outputs may be inaccurate, offensive, incomplete, or unsuitable for your intended use.

Limitation of Liability

To the maximum extent permitted by law, Nano Banana AI and its operators will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, goodwill, business, or opportunities arising from your use of or inability to use the service.

Our total liability for any claim related to the service will not exceed the amount you paid to Nano Banana AI for the service giving rise to the claim during the three months before the event, unless a higher amount is required by law.

Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, losses, and expenses arising from your content, your use of the service, your violation of these Terms, or your infringement of any rights or laws.

Termination

We may suspend or terminate your access at any time if you violate these Terms, create legal or safety risk, abuse the service, fail to pay, or attempt to bypass platform controls. You may stop using the service at any time.

Termination does not remove obligations that should reasonably survive, including payment obligations, intellectual property rights, disclaimers, liability limits, indemnity, and dispute terms.

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, unless another law is required by your local jurisdiction.

Updates to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date on this page and, where appropriate, notify users through the service or by email. Continued use after changes take effect means you accept the updated Terms.
